An argument between a 51-year-old woman and her live-in companion, 52, quickly escalated into a domestic incident that resulted in the man begin shot. The woman, who was still armed with a handgun when police arrived, told them the argument led to her retreating to the bedroom where she was able to access her handgun. When the man charged her and began to hit her, she feared for her life and fired several rounds at him, hitting him. The injured man fled, making it as far as the driveway, where police found him. He was airlifted to the hospital and is facing aggravated assault charges. The woman will not face charges. (Fox13memphis.com, Memphis, TN 11/23/20)
It did not end well for a man who allegedly violated a protection order against him, unlawfully entering the home of a woman described as the mother of his child. The woman, who told police she was sitting in her garage smoking a cigarette when the man intruded by walking through her front door, called 9-1-1 after shooting him. The man was found lying down in the garage. The shooting was still under investigation, although Ohio is a Castle Doctrine state that now includes a provision that shifts the burden of proof in self-defense cases from the defense to the prosecution. The change requires prosecutors prove beyond a reasonable doubt that the person who used deadly force did not do so in self-defense, defense of another or defense of the person’s residence.
